6-Year Limited Warranty – DURAFLEX SPF NEO

  1. Warranty Coverage:
    DURAFLEX warrants that its surface protection film will be free from defects in materials and workmanship, specifically against yellowing or lifting, for a period of 6 years from the date of installation. This warranty applies solely to the original purchaser and is non-transferable. It guarantees the product will perform as intended when properly installed and maintained, under normal and reasonable use.
  2. Australian Consumer Law Compliance:
    This warranty is provided in addition to any rights and remedies the purchaser may have under the Australian Consumer Law (ACL). Nothing in this warranty limits or excludes those rights, which include guarantees that products are of acceptable quality, fit for purpose, and match their description. For any defects or issues not covered by this warranty, DURAFLEX will comply with all applicable obligations under ACL.
  3. Exclusions from Coverage:
    This warranty excludes any claims or liabilities for damage resulting from improper use, including but not limited to:
    • Using sharp objects such as knives directly on the film.
    • Placing hot items such as pots or pans directly on the film.
    • Damage resulting from exposure to excessive heat beyond the product’s specified tolerance (220°C).
    • Failure to maintain the film in accordance with DURAFLEX’s care instructions.
    • Exposure to harsh chemicals or substances not compatible with the product.
    • Any damage resulting from improper installation or removal.
  4. Application on Chemically Sealed Surfaces:
    When DURAFLEX is applied to marble, stone, or similar surfaces, it is required that the surface be properly chemically sealed. DURAFLEX cannot be held responsible for any yellowing, lifting, or other adverse performance of the film that may result from the interaction between the film and any chemical sealants used on the surface. Any failure of the product due to the sealants or their improper application is not covered under this warranty.
  5. Self-Healing Limitations:
    The film’s self-healing properties are limited to light surface scratches and marring. Any damage beyond this scope, such as deep gouges, cuts, or mechanical abrasions, is not covered under this warranty.
  6. Removability and Surface Impact:
    When applied and removed under the recommended conditions, DURAFLEX will not cause damage to or alter the appearance of the underlying surface. However, this warranty does not cover damage caused by improper removal methods, use of incompatible adhesives, or installation/removal in conditions outside of DURAFLEX’s guidelines.
  7. Limitation of Liability:
    DURAFLEX’s liability under this warranty is limited exclusively to the repair or replacement of defective film. Under no circumstances will DURAFLEX be liable for any incidental, indirect, or consequential damages, including but not limited to any claims of damage to underlying surfaces (e.g., stone) or lost profits arising from the use or inability to use the product.
  8. Claims Process:
    All warranty claims must be submitted in writing within the warranty period and must include proof of purchase. DURAFLEX reserves the right to inspect the installation site and the product before any warranty remedy is provided. DURAFLEX may, at its discretion, offer repair, replacement, or reinstallation of the film.
  9. Exclusion of Implied Warranties:
    To the maximum extent permissible by law, all implied warranties, including any implied warranties of merchantability or fitness for a particular purpose, are expressly excluded from this agreement, except as required under Australian Consumer Law.
  10. Governing Law and Jurisdiction:
    This warranty shall be governed by the laws of Australia. Any disputes arising out of or related to this warranty shall be subject to the exclusive jurisdiction of the courts of Australia.
